Terms of Use and Privacy Policy for the Website – Judaica Jerusalem Store

Welcome to the Judaica Jerusalem Store website, a platform for selling a variety of products related to Judaism as they appear on the website from time to time (hereinafter: “the products”).
The owner and operator of the website is Shlomo Zwerdling, business number 051981132 (hereinafter: “the company” and/or “the website” and/or “the website operator”).
The terms of use regulate the relationship between the website and any person browsing and/or using the website or the information found on it (each one referred to hereinafter as “the customer” and/or “the user”).
All use of the website and the contents displayed on it, including browsing and viewing it, as well as any action taken on it, including purchases, is subject to the terms of use detailed below. Users are requested to read these terms carefully. A user is not obligated to agree to these terms, but if they do not agree, they are required to leave the website immediately and not use it. The beginning of use of the website indicates the user’s consent and approval of these terms of use.
The use of the website constitutes the user’s agreement to all its terms without limitation and/or reservation, and by using the website, the user commits that they or anyone on their behalf will not have any claim and/or demand, directly or indirectly, against the website and/or its operators and/or its owners and/or managers or anyone on their behalf.
The terms in this document are written in masculine form for convenience but are intended for all genders.
The section headings are for convenience and orientation in this document and shall not be used for interpretation purposes.
Product images displayed on the website are for illustration purposes only and do not bind the company in any way.
The website reserves the right to modify and change promotions and offers, as well as to discontinue them at any time without prior notice, and no double promotions will be allowed unless stated otherwise by the website operator.
Access to and use of this website, including the use of any content and/or information and/or services that may appear from time to time, are subject to the terms of use detailed below and the applicable laws in the State of Israel.
The website and its contents are intended for personal use only and not for commercial use unless specific written approval has been granted by the website operator.
Any person or company performing any action on the website, including purchasing (referred to here and below as “the customer”), declares that they have read this document, understood it, and its terms, and that they agree to its terms and provisions.
The customer declares that they are legally competent to perform binding legal actions. If the customer is under the age of 18, they must inform their legal guardian of the site’s provisions and terms and obtain prior approval for any actions on the site.
The services provided on the website are granted within Israel and outside of Israel in certain areas defined from time to time by the company at its sole discretion (“the service area”).
To make a purchase on the website, the customer must complete a form providing personal details, including for the purpose of delivering the products and processing payment.
The customer undertakes to indemnify the company for any damage caused by providing false information and disrupting the operation of the website.

Products and Website Responsibility
There may be differences in packaging or slight changes between the image displayed on the website and the product delivered.
The user declares that they are aware that the products are Judaica items, some of which are made of silver, and that reasonable wear and tear may occur to these products based on their nature and components.
It is the user’s sole responsibility to maintain the longevity of the products according to their type, and the website will not be liable for improper use of the jewelry or any damage resulting from such use (the website offers tips for maintaining the life of the products).
The products appearing on the website may be manufactured and/or imported and/or marketed and/or supplied by third parties. Customers confirm and declare that they are aware of this and that they will be responsible for contacting the manufacturer and/or importer and/or marketer and/or supplier for any compensation due to damage, direct or indirect, including bodily harm, beyond the cost of the product.
If a product purchased on the website is out of stock or found to be defective, the customer will be notified by email or phone. In this case, the company will offer the customer an equivalent replacement product. If the offer is accepted, the order details will be updated. If the customer is not interested in the replacement product, they will have the right to refuse it, and the order will be canceled.
The website will not be liable for any damage and/or loss incurred by the user due to the use of a product, directly or indirectly, or due to a defect caused by a third party.
The content on the website is provided “as is.” It cannot be tailored to the needs of each person. The user will not have any claim or demand against the website regarding the content, its abilities, limitations, and/or its suitability for their needs. The use of the website is at the user’s sole responsibility.
The use of the website and its products is at the full and sole responsibility of each visitor. The website does not guarantee that the content and services provided will be complete, accurate, legal, or suitable for every visitor’s expectations. The website will not be responsible for any result derived from using or relying on them, including: (1) errors or inaccuracies; (2) damage to body or property resulting from using or purchasing from the website; (3) interruptions to or from the website; (4) any bug, virus, trojan, etc., transmitted to the website by a third party.
The company’s liability in any case shall not exceed the purchase price paid by the buyer.

Prices on the Website
Prices, availability, and other purchasing conditions are displayed on the website’s pages and may change from time to time. The website reserves the right to change the range of products and/or services or discontinue them or change their prices without prior notice.
When placing an order, you are responsible for providing accurate, up-to-date, and complete information. The website reserves the right to verify the details entered after placing the order and may cancel or limit the order at any time. If payment was made for a canceled order, the website will refund the payment through the same payment method used.
If, for any reason, the credit card company refuses to process the payment for a purchase on the website, the website may suspend or terminate the service immediately and may demand payment, plus any costs incurred by the website due to the refusal (including third-party penalties), through other means at the website’s discretion. If the website must take legal action to collect outstanding payments, you agree to reimburse the website for all related expenses, including attorney fees and additional legal costs.
Purchases on the website are subject to additional terms and conditions of the credit card companies and/or other payment methods available on the website.

Placing an Order
When placing an order on the website, users will be required to enter basic details such as their name, address, email address, phone number, and credit card number. To ensure that the order is processed quickly and without issues, accurate information must be provided, otherwise, the website operator cannot guarantee the order will be processed.
Payment methods available on the website include credit cards and/or PayPal through an authorized and secure payment processing site.
For certain purchases, the company may perform additional verification of the buyer by sending an SMS to the credit card holder for transaction confirmation.
It should be noted that knowingly providing false information may constitute a criminal offense. Those providing false information may be subject to civil and criminal legal action, including damage claims for any harm caused to the website operator due to the disruption of the website’s operation. In addition, the information provided by the user on the website will be used, among other things, for sending promotional emails or website updates.
When placing an order, the website operator will check the payment method provided by the purchaser, and upon receiving approval from the credit card companies, the user will receive a confirmation message that the order has been approved. It is clarified that the user will be charged for the purchased item upon the completion of the order.
The purchase transaction will only be completed after the order process is finalized and the website operator receives approval from the relevant entity for the charge, in accordance with their existing procedures. If the transaction is not approved by the credit card companies, the customer will receive a notification. The completion of the purchase transaction also depends on the availability of the requested items in the website operator’s warehouse at the requested delivery date and/or at the time of the order (even if the website indicates that the product is in stock). If the product is not in stock, the order will be canceled or replaced, and if the user wishes to cancel the order, they will be refunded accordingly. To remove any doubt, the user will have no claim and/or demand against the website and/or anyone on its behalf regarding any damage, direct or indirect, caused to the user and/or a third party as a result. It should be emphasized that there may be situations where, despite a product appearing as available on the website, it is actually not in stock and cannot be supplied.

Product Delivery
Self-pickup is available by prior arrangement at the address: Moshe Dayan 39, Pisgat Ze’ev, Jerusalem.
Shipping fees will be added to the price of the items listed on the website. The shipping fee is for delivery to one destination.
The shipping cost may be updated from time to time as specified at the time of order placement on the website.
The website may set a minimum order amount.
The website will deliver the products to the customer via an independent courier service throughout Israel and via an international courier delivery company for shipments abroad. The shipping company’s regulations, through which delivery is made, will apply to the delivery of the product via the website and will bind the customer.
Upon receiving and confirming the order by the website operator, the order will be prepared and packaged within 10-20 business days from the confirmation date. Orders placed after 12:00 PM will be considered as placed on the next business day.
Product delivery by the shipping company will take place within a few days of placing the order on the website (up to 21 business days), except for remote areas where delivery times may be up to 40 business days. International shipments may experience delays depending on the schedules of the international shipping company. In rare cases, such as during busy periods (launch weeks, etc.), shipping times may be extended.
To ensure efficient and trouble-free order processing, all required details must be provided accurately and up-to-date on the website. If incorrect information is provided when placing the order, the company cannot guarantee the order will be received, processed, or that the products will arrive at their destination. If the products are returned to the website operator due to incorrect information provided, the website operator reserves the right to charge the customer additional shipping fees.
Orders that have received a confirmation message and where the product is in stock will be delivered directly to the address provided by the customer via an external courier company.
It is clarified that orders placed after 12:00 PM will be considered as orders for the next business day.
If an order is received for areas that the shipping company does not service, in accordance with the shipping company’s regulations, the website is not obligated to fulfill it. The website may, at its discretion, deliver orders to areas outside the delivery zones with prior telephone coordination.
The website operator is not responsible for delivery times and delays by the shipping company, but it will assist the customer in resolving any issues. The website operator is not responsible for delays in product delivery due to events beyond its control, such as technical issues, delays, strikes, natural disasters, force majeure, wars, emergencies, computer system or telephone system malfunctions that affect the completion of the purchase process, email service issues, or any delays caused by the coronavirus, including lockdowns, restrictions, and other reasons beyond the website operator’s control.
Typically, delivery will be made to the address provided, but in community settlements, villages, kibbutzim, etc., products may be delivered to the community office. In such a case, you will be notified by phone or in writing.
Delivery Confirmation: Delivery confirmation is done by the recipient’s signature, which must be an adult. In the event of a request to leave the delivery without a personal handover, the courier will photograph the delivery at the drop-off location, and the company will not be responsible for the condition of the product or its receipt by the customer thereafter.
It is the customer’s responsibility to check the order confirmation sent to the email address they provided to ensure there are no errors in the order. No claims will be accepted regarding differences between what was ordered and the contents of the order confirmation.
Any notice regarding a defective or missing product must be submitted in writing to the company offices within 3 business days from the delivery date. If the shipment has not arrived, notice must be given within 3 business days of the latest expected delivery date, according to the delivery times detailed above.
In case of no response to delivery coordination messages from the courier company, the shipment will be returned to the company. Resending it will incur a new shipping fee.

Return, Exchange, and Order Cancellation Policy
The provisions in this section are subject to the Israeli Consumer Protection Law, 1981 (hereinafter: “the Law”).
Requests for returns, exchanges, or cancellations must be submitted to the website using one of the contact methods listed at the bottom of the terms and conditions.
According to the Law, cancellation or return of products customized for the customer based on their specifications will not be allowed.
It is clarified that no monetary refunds will be provided for products made specifically for the customer according to their specifications or measurements, nor for products with a total cost exceeding 3,000 NIS.
Additionally, if a customer wishes to return a product with a total cost exceeding 3,000 NIS that was not custom-made, the website operator will allow a credit for future purchases on the website only, within 30 days of the original purchase date.
Returns, exchanges, or cancellations of other products will be allowed for a refund or exchange within 14 days after the customer receives the order.
The refund will be made using the same payment method the customer used for the order.
If the return, exchange, or cancellation is requested after 14 days from receiving the order, the request will be subject to the website’s sole discretion.
Returns, exchanges, or cancellations will be approved after the customer receives written confirmation from the website.
If a return, exchange, or cancellation is due to customer regret (and not due to a defect or non-compliance) and has been approved by the website:

  • The customer must return the product to the website in its original condition as received.
  • The product must not have been used in any way.
  • The product must be returned with a receipt or proof of purchase.
  • The customer will bear the costs of returning the order.
  • A cancellation fee of 5% of the product price or 100 NIS (whichever is lower) will be charged.
    If a return, exchange, or cancellation is due to a defect in the product, the website will be responsible for collecting or exchanging the defective product from the location where it was delivered.
    A product claimed to be defective by the customer will be inspected by the website. If, after inspection, the product is found to be in good condition or if the defect occurred after the customer received the product due to unreasonable use, the customer will not be entitled to a refund and may request the product be sent back to them, subject to an additional shipping fee.
    The website operator will have sole and absolute discretion regarding the condition of the returned goods. Items that show any signs of use cannot be returned, and the user will not be credited for the purchase amount, all subject to the website operator’s sole discretion.
    Transactions made using debit cards (direct cards) cannot be refunded, and refunds will be made via bank transfer.
    A single item purchased as part of a set of products cannot be returned unless the individual item is defective, and such returns are subject to the website operator’s approval.
    The provisions of the terms and conditions are subject to the Israeli Consumer Protection Law, 1981.

Prohibited Activities on the Website
You are not permitted to use the website except for the purposes for which it is intended. The website may be used for private and personal purposes only, and not for commercial purposes unless specifically approved by the website.

The website may use links to other websites (“Third-Party Sites”) as well as articles, images, text, graphics, designs, music, sounds, videos, information, applications, software, and content or items that belong to or originate from third-party websites (“Third-Party Content”). Third-Party Sites and Third-Party Content are not investigated, monitored, or checked by the website, and the website is not responsible for any Third-Party Content posted on, accessed through, available via, or installed on the website, including its accuracy, reliability, privacy policies, or other practices of such third parties.
The use of or access to any Third-Party Site or Third-Party Content via a link or the allowance of such use or installation does not imply endorsement or approval by us, and accessing these links is at your own risk. It is your responsibility to check them before using them.
The website is not responsible for any purchases you make from third-party websites or other companies, and any transactions will be strictly between you and the relevant third party.

Website Management
We reserve the right to: (1) monitor the website for violations of these terms; (2) take legal action against anyone violating the law or these terms, including, without limitation, reporting the user to law enforcement authorities; (3) refuse, restrict, or disable (to the extent technologically feasible) any of your contributions to the website, in our sole discretion, and without limitation; and (4) manage the website in a way that protects our rights and property and facilitates proper functioning.

Intellectual Property
All intellectual property rights on the website, including its content, design, software, application, code, graphical files, images, text, and any other material, belong solely to the company. You may not copy, photograph, distribute, publicly display, or provide any part of it to a third party.
You are prohibited from reproducing, copying, publishing, marketing, distributing, or creating derivative works from any part of the website without prior written consent from the website operator.
The domain name of the website, the website itself, brand names, trademarks (registered or not), and all associated materials are the exclusive property of the website operator. You may not use any of these without prior written consent.

Termination of Website Activity
The website reserves the right to terminate its activity or cancel an order at any time and at its sole discretion.
If an order is canceled by the website, the customer will be fully refunded for the amount they paid.
If the website ceases its activity and/or cancels an order due to an error in the product description, incorrect price, or for any other reason, the customer will have no claim or demand against the website or its operators. Alternatively, at its discretion, the website operator may approve a new transaction under modified terms.

Miscellaneous
These terms apply to the website and its services across all devices (such as smartphones, tablets, desktop computers, etc.). The terms also apply to the use of the website through the internet or any other communication network.

The laws of the State of Israel shall apply to these terms and your order. Any disputes will be subject to the exclusive jurisdiction of the court in the Jerusalem district.
